TERMS OF AGREEMENT

1.             Accurate Information

Evolved Sound will provide the Affiliate with accurate pricing and marketing information through the Evolved Sound website, shop.evolvedsound.com.au, and through email and written quotation. As the prices for options and international currency conversions may vary from time to time, it is the responsibility of the Affiliate to ensure that pricing is correct before quoting the Customer.

a)                 The Affiliate will represent the services and prices of Evolved Sound accurately.

b)                 The Affiliate will not represent himself as being an employee of Evolved Sound.

c)                  The Affiliate will not provide any guarantees or warrantees on behalf of Evolved Sound over and above those stated in these Evolved Sound Terms.

2.            Provision of Services

When an Affiliate submits an order either through the Evolved Sound web site or by other means, the Affiliate accepts the Evolved Sound Terms and Conditions on behalf of the Customer. Affiliates may add their own Terms and Conditions under which the Affiliate provides services and/or products, but may not alter or amend the Evolved Sound Terms and Conditions.

3.            Commissions

Commission will be paid to all Affiliates at the rates displayed on this website.

Commission is paid when commission reaches a minimum of AUD $150 by Cheque. Cheques are written in Australian Dollars ONLY.

Commission is gained on paid purchases only.

4.            Ownership

Upon termination of the agreement, the end user Customer remains the property of Evolved Sound.

5.            Suspension

Evolved Sound has the right to, and may suspend Affiliate status if:

a)                 The Affiliate breaches any of his or her obligations under the agreement;

b)                 The Affiliate does not sell a Evolved Sound product for 12 months.

6.            Termination

Either party may terminate this agreement by giving the other party 14 days written notice of their intention to terminate.

Evolved Sound has the right to, and may terminate Affiliate status if:

a)                 The Affiliate breaches any of his or her obligations under this agreement.

b)                 The Affiliate does not sell a Evolved Sound product for 12 months and does not contact Evolved Sound annually to confirm the Affiliates details.

7.            Governing Laws

This Agreement takes effect, is governed by and shall be construed in accordance with the laws of Victoria and the Commonwealth of Australia.

8.         Entire Agreement

This Agreement constitutes the entire agreement between the parties and any previous agreements, understandings or negotiations shall be superceded and replaced by this agreement.

9.            Modifications to Agreement

Evolved Sound has the right to modify this agreement or commission rates in any way without prior consent from Affiliates. All reasonable efforts will be made to notify Affiliates of any changes.
